THE EARNEST MONEY DEPOSIT – WHAT IS IT?

Realtors say the oddest things and just assume you understand! I personally JS Realty Terms Word Cloudremember sitting in my Real Estate class, thinking “I am learning a whole new language!” It was a bit overwhelming, even though I had the desire to understand each and every word, along with its definition. Not everyone understands Real Estate terms, especially if this is your first time working with a Realtor. Over the next couple of months, the JS Realty Team will work towards enlightening you and helping you learn our “Real Estate Language.”

What is an Earnest Money Deposit (or “EMD”)? And why do I need to pay one?
JS Realty Deposit slipAn Earnest Money Deposit is an important part of the home buying process. It is an amount of money that you will deposit (in escrow) that tells the Seller you are committed to the purchase of the home. It’s important to know that this earnest money deposit is not an extra cost of buying a home. It will be credited towards the down payment at closing, and in case it exceeds your mortgage down payment, and settlement cost, you will receive the balance at closing.

How much should I offer?
This can differ depending on the real estate markets and can also depend on JS Realty Calculating Money Financewhether or not there are multiple offers on the property. If you feel that you are not in competition, you can expect to pay around 1-2% of the sales price in most markets. For example: a $300,000.00 sales price x 1% = $3,000.00 EMD. If you are in competition with other offers, you may want to offer more, as this will tell the Seller you are more serious about their home and could help you win the offer. This is where a good Realtor can really help you structure the correct offer with the right amount of EMD.

Where did my money go and how is it being spent?

In most cases you will write the check to your Realtors, Real Estate Brokerage Company or the company that will be assisting you in the settlement (Title Company). Never write the check to the Seller or the Realtor directly. The money is usually due very shortly after the contract is fully accepted by all parties (ratified) and will be placed in an escrow account. Shortly before you go to settlement, it will be released so it can be applied towards your settlement cost and down payment on the day you purchase the home. In the event the amount you put down exceeds the amount needed for these cost, you will get a check refunding you the balance. As you can see, this is your money, and it is treated as such. It is only applied to your cost.

What if I do not buy the house? How do I get my money back?
Every market can be different when it comes to answering this question. Make sure you read and understand the contract and that it states what happens to the EMD if you no longer qualify to by your dream home, or you discover during the home inspection process that there is something that does not meet your expectations and you decide you do not want to buy the home. If you are within your rights to cancel the contract, the Seller will agree to release the funds back to you in full. However, there are many different ways this can be handled and some are not favorable, so, understand the contract you are signing and discuss any concerns you may have with your Realtor. If you are not comfortable with the language that is written in the contract be sure to consult an attorney before signing to ensure your rights are protected too.

THE BOTTOM LINE
An EMD (earnest money deposit) is your way of telling the Seller “I love your JS Realty People shaking hands in a real estate transactionhome and really want to buy it.” In most cases the money remains yours and is applied to your cost in regards to the purchase. It can also be a great way to leverage your offer in the event you find yourself in competition with another Buyer. A great Realtor can guide you in the offer process and help you structure a deal that is more than just about a sales price.

THE HOME INSPECTION PROCESS

Congratulations – you are one step closer to owning a home! Once you have ratified a contract on the home of your dreams (meaning you have a contract to purchase a home at terms agreeable to all parties), the first & very important step is to perform your home inspection. At JS Realty we feel the home inspection is the most important step in the home buying process. JS Realty has a team of qualified Inspectors for whatever is needed for a home. A general home inspector checks all the components and systems of the home interior and exterior. If specific issues are found, sometimes it is necessary to bring in a specialists from that field, such as a structural engineer, roofer, HVAC contractor, or others. We encourage our buyer’s to accompany the home Inspector as he inspects the home. Our home Inspectors provide a resource to learn as much as you want about the components of your home, gleam valuable tips on maintaining the home and what systems need regular preventative maintenance.

CHOOSING YOUR REALTOR

You have made the heart felt decision to buy or sell a home. On average, most people only buy or sell real estate a couple of times in their entire lives. Now that you are ready, hiring the right Realtor should be at the top of the list. Yes, most of us have a family member or a friend that “might” be able to help, but let’s be real – unless you know they are fully committed to the job as a full time agent and are the best at what they do, you may want to rethink who you are choosing and why.

Why should you care? You are about to embark on a transaction that involves more than 15 professionals (and their staff) to help get you to the settlement table. Coordinating and managing these professionals is a job in and of itself. You deserve a high level of service and below are some key questions you should consider asking a Realtor prior to engaging their services.

1. How long have you been in the business and how many transactions have you been involved with? You will know more about their experience by how many transactions they have been involved with. The number of transactions a Realtor has completed = knowledge of the market place and ability to create successful sales. For example: A 15 year agent has participated in 25 transactions during their career, but a 5 year agent has participated in 75 transaction during their career. It’s the transactions that create the experience, not necessarily the years of service.

2. Are you a full time Agent? The level of service and communication you receive is key. Hiring a Realtor that is committed to the job as a full time venture, should be at the top of your list. Most of the professionals involved in the transaction work M-F, 9am to 5pm. Your Realtor will need to be able to communicate and coordinate with these professionals to provide you the highest level of service and simplify what is needed from you. If an agent is only able to help you on their lunch break or after they are done with their other job, things can easily get out of control or fall through the cracks. You deserve the commitment and attention a full time Realtor can provide.

3. How will you communicate with me? Your Realtor should be able to accommodate your style of communication. If you are someone who likes to email, then a phone call or text may not be the best way to communicate with you. If you are out of the area and can’t see a house, a video tour of the home can help a lot too! Realtors have all sorts of services available to them, including electronic signature services. This not only saves you paper and ink, but time – there’s no need to print, sign, scan and email anymore. Understanding what tools and resources your Realtor has available to them can save you a lot time. Be sure to ask and make sure you are working with someone who can accommodate your preferred level of communication.

If you are selling a home, it will be important to understand and know what you are getting for the fee. Also ask for a breakdown of estimated closing costs, as they are different from state to state, and can also differ depending on if you are buying or selling. Understanding this upfront, can save you from “unforeseen surprises” later in the transaction.

While it’s usually legal to represent both parties in a transaction (with proper disclosures), it’s important to understand where your Realtors obligations lie. Have your Realtor explain their agency relationship to you and describe the rights of each party. TO PAINT OR NOT?

To paint or not to paint? This is a very popular question – we get this question almost every time we meet with sellers. Get started by taking a look around to evaluate your home. You have one chance to make a first impression and it really needs to count. Let’s start outside the home first.  Take a quick look around and consider how the entrance to your home looks.  Ask yourself, “Is it going to make the Buyer feel welcome?” Besides sprucing up the yard, take a look at your mailbox, fencing, lamp post and entry door. Make sure each of them look their best, and if not, a fresh coat of paint will do the trick.  Remember: if you have an HOA, choose colors your HOA will allow.

MARKET REPORT FOR ASHBURN, VA

From the number of active homes on the market to the number of homes sold so far this year, the JS Realty Team will keep you updated on the Ashburn Real Estate market.

As of April 5, 2015 there are currently 473 homes on the market in Ashburn Virginia. Ranging from a 2 bedroom, 1 bath condo listed for $182,900 to a gorgeous home sitting on over 11 acres that boasts over 8,000 finished square feet of living space for $2,499,990. The median list price is $515,000 – which is slightly above the median list price for Loudoun County ($500,000).

So far in 2015, Ashburn Virginia has real estate market graph increaseseen a pretty steady pace of sales with 280 homes sold. THE LOAN PROCESS

JS Realty PreApproval BlockA pre-approval is a commitment by a lender to make a mortgage loan to a specified borrower, prior to the identification of a specific property. The pre-approval process starts with an interview and completion of a loan application, and ends with the lender issuing a pre-approval letter demonstrating that the applicant is a suitable buyer. The lender will typically require at minimum 2 years of W2 statements, 2 years of federal tax returns, 2 month’s of asset account statements, and a satisfactory credit report.

JS Realty Rate Lock BlockAt this step the lender issues a written agreement guaranteeing the borrower a specified interest rate, provided the loan closes within a set period of time. To lock a rate the applicant must have a ratified contract and an established settlement date.

JS Realty Disclosure BlockThis is when the lender offers the official Good Faith Estimate, Truth in Lending Form and loan disclosures. These documents need to be presented to the applicant within 3 days of lock and will need to be signed and returned to the lender. It is also common for the lender to request additional supporting documentation at this point.

JS Realty Appraisal BlockAn appraisal is a written analysis of the estimated value of a property prepared by a qualified appraiser. This process is performed to make sure that the property is of fair market value and supports the agreed upon purchase price.

JS Realty Processing and Underwriting BlockDuring the processing step the Loan Officer and his/her staff will gather and analyze all of the information to ensure that the applicant’s loan will meet the specific program guidelines. The Underwriter will then complete the final review of documents to verify that all appropriate disclosures and documentation is completed to support the issuance of final loan approval. It is common for the Underwriter to request additional explanations or documentation during this process.

JS Realty Closing BlockThe closing is a meeting in which the sale of a property is finalized with the buyer signing the mortgage documents and paying closing costs. Also called “settlement.” This is where the applicant receives their keys to their brand new home!

BUYING A HOME IN BRAMBLETON

Buying a home should be an exciting experience! When you finally decided “it’s time”, the JS Realty Team is ready to help guide you every step of the way. We are happy to make a recommendation for financing with one of our trusted lenders. We will put you in touch right away, so you can begin to understand how much you can afford and which financing options are the best for you.

Once you have the financing portion started, and you have determined your JS Realty Couple with Realtorpurchasing power, your designated agent with The JS Realty Team @ Samson Properties will schedule a home tour. Allow approximately 2-3 hours for your tour depending on your home selection. You are welcome to ride along with your agent, or follow along in your own vehicle.

We want to know more about your needs, and we will set aside time to learn more about you and help guide you on what is going to be the best fit for you. Our experience shows us that most buyers will narrow down their selection to 4-5 homes – from which they will choose one. When there are more homes than that on the tour, it probably means the agent didn’t narrow down enough “specifics”, or you are in luck with a massive inventory in your area and price range and are not too “picky”. You can help narrow down time by browsing through the photos and home features in the MLS listing your agent has sent you and eliminating any homes that are not strong candidates for your selection.

Suggestions for a productive home tour:

  • Have all decision makers on the tour
  • Be prepared with things to keep the kids busy on the tour so you can focus on notes and questions
  • Bring a digital camera and take pictures of each home or better yet, capture video. Your smart phone is great for this. Your agent would be happy to follow along and record for you so you can take notes.JS Realty Team Gorgeous Master BD
  • Have a pen/pencil and notepad to make notes. You will forget. It’s important to note LIKES and DISLIKES for each home.  Example: Island in kitchen is amazing. 2nd bedroom room for nursery is a bit small. Love the tub in the master bathroom! Home will need a deck.
  • Upon leaving each home, rank the home on a 1-10 scale on how likely you would be to write a compelling offer.
  • During the hot months, frozen bottles of water are a great idea for the trip. Some homes will not have power or air conditioning. In the cold months, remember your jacket and gloves.
  • Don’t wear shoes that you are worried about scuffing. You will be walking the lots to learn more about the property; keep in mind being able to be comfortable inside the home and out.
  • Be prepared to write an offer. Remember you are looking to buy a home so there is not much sense in touring homes when you are not prepared to buy, as those homes are certain to not be available at a later date.
